Terms of Use and Conditions

Welcome to JobSafePro a platform designed to streamline staff inductions, incident reporting, and data storage. PLEASE NOTE that by proceeding and accessing or using our Application, you agree to comply with and be bound by the following Terms of Use and Conditions including the terms of our End User Licence Agreement (“Terms”). Please read them carefully before using the Application. Please save a copy of this Agreement for your own records.

For the avoidance of doubt a reference to Us or We or Our is a reference to JobSafePro. A reference to You or Your is a reference to the User who has entered into these terms of Agreement.

1. Acceptance of Terms

By accessing or using JobSafePro, you agree to these Terms and to the terms of our our Privacy Policy. If you do not agree to these Terms, you must not access or use the Application. You must not allow anyone else to access or use Induct Pro on your behalf unless you have ensured that they have also entered into and acknowledged the terms of this agreement.

2. Use of the Application

a. Eligibility:
You acknowledge that you must be at least 18 years old or the legal age of majority in your jurisdiction to use the Application.

b. Permitted Use:
You understand that the Application is intended solely for staff inductions, incident reporting, and data management within an organisation. Unauthorised use, reproduction, or distribution of the Application or its content is expressly prohibited.

c. Account Security:
You agree that you are solely responsible for maintaining the confidentiality of your account login information and for all activities under your account.

3. Data and Privacy

a. Data Collection:
We collect and process personal information as described in our Privacy Policy. By using the Application, you consent and authorise us to such collection and processing.

b. Data Accuracy:
You acknowledge that you are responsible for ensuring that any data you input into the Application, including incident reports and employee information, is accurate and up-to-date.

c. Confidentiality:
All information submitted through the Application, including incident reports, is considered confidential and will be handled according to our Privacy Policy and applicable data protection laws.

d. By using this application you acknowledge that it is your responsibility to obtain the consent of any third party for the use of their information in the JobSafePro application.

4. Incident Reporting

The Application facilitates incident reporting for workplace health and safety. You are expected to report incidents truthfully and responsibly. You understand and agree that misuse of the incident reporting feature, including false or misleading reports, may result in suspension or termination of access.

5. Intellectual Property

We disclose that the content, software, and materials available on the App, including logos, text, graphics, and designs, are the property of JobSafePro or its licensors and are protected by intellectual property
laws. Unauthorised use of any materials from the Application is strictly prohibited and we reserve all of our rights in respect of same.

6. Prohibited Activities

You agree not to:

Use the Application for any unlawful purposes or in violation of any applicable laws.
Attempt to gain unauthorised access to the Application, its systems, or user data.
Transmit any harmful code, viruses, or other malicious software through the Application.
Misrepresent your identity or the information you provide within the Application.

7. Limitation of Liability

We disclose and you acknowledge that to the fullest extent permitted by applicable law, JobSafePro, its affiliates, directors, officers, employees, agents, partners, and licensors shall not be liable to you for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of profits, data, use, goodwill, or other intangible losses,
Resulting from:-
(i) your access to or use of, or inability to access or use, the Application;
(ii) any conduct or content of any third party on the Application;
(iii) any content obtained from the Application; and
(iv) unauthorised access, use, or alteration of your transmissions or content,

whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

In no event shall JobSafePro’s total liability to you for all claims arising out of or relating to these Terms or your use of the Application exceed the amount paid by you, if any, for accessing the Application in the twelve (12) months preceding the event giving rise to the claim and in any event shall not exceed the sum of $200.00.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above exclusions or limitations may not apply, and you may have additional rights.

8. Termination

We reserve the right to suspend or terminate your access to the Application at any time, without notice, if we believe you have violated these Terms.

9. Modifications to Terms

We may modify these Terms from time to time. Changes will be effective upon posting to the Application. Your continued use of the Application after changes are posted constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia and each party irrevocably submits to the non-exclusive jurisdiction of the courts of Queensland.
